The procurement comprises the purchase of the active ingredient Acetylcysteine with inhalation formulation, to all of the health authorities in Norway. The Contracting Authority intends to enter into into an agreement with Mylan Hospital AS. According to the public procurement regulations of 12.8.2016, No 974 § 13-4 letter b) No 3 the contracting authority can implement a procurement without competition if the ‘procurement apply to products that only one supplier can deliver, due to the supplier's exclusive rights, including intellectual property rights’. Mylan Hospital has the exclusive right to deliver Acetylcysteine with inhalation formulation for paracetamol overdose treatment of patients. Only Mylan Hospital has the permission to deliver this product in Norway. Based on this the contracting authority means that it is only Mylan Hospital AS that can deliver the active ingredient Acetylcysteine with inhalation by mouth, and there is a legal basis in the Public Procurement Regulations § 13-4 letter b) No 3, to enter into a contract with Mylan Hospital AS for the procurement of the product.
