Cancellation of the competition. The contracting authority refer to the contract for Transport and treatment of waste based fuel.
According to the Public Procurement Regulations § 22-1 (1), Cancellation of the competition and total rejection, the contracting authority can cancel the competition with immediate effect if there is a justifiable reason.
We also refer to point 3.4 in the tender documentation, which gives the contracting authority the right to cancel the competition if there is a justifiable reason. In accordance with this point, the contracting authority can cancel the tender competition with immediate effect.
Justification:
According to the Public Procurement Regulations, § § 20-16 (2) d, the contracting authority's obligation to provide a reason, the contracting authority shall as soon as possible provide written notification with a short justification if the competition is cancelled, jf. § 22-1.
After the production plans for 2015 have been reviewed, the company has experienced altered conditions, which unfortunately results in cancellation of this tender competition. The cancellation is executed prior to deadline for receipt of tenders, and tenders already received will not be opened.
