Cancellation of the competition. The contracting authority refers to the framework agreement for the provision of green maintenance in Tasta district.
According to the Public Procurement Regulations § 22-1 (1), Cancellation of the competition and total rejection, the contracting authority can cancel the competition with immediate effect if there is a justifiable reason.
We also refer to point 3.13 in the tender documentation, which gives the contracting authority the right to cancel the competition if there is a justifiable reason. According to this point the contracting authority can reject all the tenders if the result of the competition justifies this.
Justification:
According to the Public Procurement Regulations, § § 20-16 (2) d, the contracting authority's obligation to provide a reason, the contracting authority shall as soon as possible provide written notification with a short justification if the competition is cancelled, jf. § 22-1.
When reviewing the received tenders, the contracting authority has had to reject a tenderer in the competition. After the rejection the contracting authority only had one tenderer left. We cannot therefore make a real comparison of prices and other terms. There is, thus, no real competition situation and the contracting authority is, thus, of the opinion that there is a «justifiable reason» to cancel the competition. A new competition will be announced in the near future.
