The Danish Defence Acquisition and Logistics Organization (DALO) has decided to terminate the tender for a Framework agreement on Identification Friend or Foe (IFF) systems, spares, training and service without an award. Notice has been sent to the Official Journal.
The reason for the termination is that it was stated in the contract notice 2013/S 127-217976, Section III.1.4) that it was "a condition for the contract, that the tenderer before the signing of the contract also enters into an Industrial Cooperation Contract with the Danish Business Authority (Erhvervsstyrelsen) in accordance with the Danish "Erhvervsfremmeloven" and the associated "Circular on Industrial Cooperation in connection with Procurement of Defence Equipment" No. 88 of 27 October 2010.".
As the mentioned regulation governing the requirements for an Industrial Cooperation Contract with the Danish Business Authority has been abrogated on 2 April 2014 DALO has decided to annul this tender as the abrogation of the previous regulation concerning Industrial Cooperation constitutes a fundamental change of conditions for this tender set out in the Contract Notice 2013/S 127-217976.
