Here it is worth mentioning that VAV has several self-developed systems on ArcGIS, such as MIDA (used in case proceedings) and sewage operational events, VAV's DV system obtains a map via the ArcGIS server, RioGIS is entirely built on ArcGIS software and the modelling environment actively uses ArcGIS in its daily work. The above mentioned agencies depend on ESRI software so that they can continue to use developed services and applications and have awarded the supplier Geodata AS a new joint licence contract for ESRI software. See point II.1.4) Short description. The supplier Geodata AS currently has a monopoly as the supplier of ESRI licences in Norway. This prevents competition between several actors for the delivery of ESRI software. The alternative to procuring without a competition, is a development project to cover the need by using other software than ESRI. Such a development project would not be a reasonable alternative to only getting a licence service. The procurement documents are not adapted to the supplier Geodata AS, but refer to a specific technology — “ESRI”, for which the supplier Geodata AS has the monopoly. The terms for making a procurement without a competition, in accordance with FFO § 9-3, letter b (2) and (3), are, based on the above, deemed to be fulfilled.
