A framework agreement will be signed with Fresenius Kabi Norge AS. The products are already used by the Norwegian health authorities. There is currently only one manufacturer who has the necessary qualified premises, equipment and personnel in Norway to carry out contract production for a portfolio that includes a-preparations and that are manufactured in accordance with the Chemist Act. These are chemist produced products. Where the chemist only has 1 weeks shelf life for its productions. 4420000.00 The exception for direct procurements is in the Public Procurement Regulations § 13-4 (b). The provision states that the contracting authority can hold a procurement without a negotiation if the procurement is for services that only a specific supplier can provide as ‘competition is impossible due to technical reasons’. Technical reasons mean that there is only one tenderer who can carry out the service or produce the product. It is not probable that any new contract producer will be able to establish and get the necessary authority certifications for equivalent production in time for the contract to be signed with Sykehusapotekene HF. Sykehusapotekene HF also fears delivery lapses and, as an extreme consequence, this can affect patient safety if we have to wait for a public procurement and facilitate so that a new actor is able to establish equivalent production premises in Norway before a contract can be signed. The contract that will be signed is a continuation of already existing contracts, where the main purpose has been to upgrade the formal content so that they meet changes in the laws and regulations. Sykehusapotekene HF knows the contract production market well and cannot see that any other supplier of this type of contract production services for sterile stock products exists in the market after a market survey. There is only one supplier who can deliver the specifications that SykehusapoteteneHF has as requirements. The market survey was thorough, we were out in the pharmacy and medicament environment with our network and at conferences where pharmacists, researchers and the supplier market meet and interact. The procurement is covered by the procurement regulations § 13-4 a). The waiting period is set to 10 days, calculated from the day after the intention notice.
