The Local Investment Climate (LIC) is a sub-component of the Business Sector Programme Support Phase IV. LIC focuses on the critical constraints to business growth and economic development at the district level. The sub-component will help the Local Government Authorities (LGAs) and the business community to identify and prioritize the challenges it faces in the local business environment and will facilitate the creation of district-level Public-Private Dialogue (PPD). LIC will support practical reform initiatives within areas as business registration and licensing and local land use and administration that remove local obstacles to business growth. Furthermore, the LIC will establish a Small Industrial Facilities Fund (SIFF), which will facilitate investments in public infrastructure and private business facilities with public good characteristics to unlock critical constraints in local markets and value chains, and create new business opportunities for local business women and men. The investments will be targeting the agribusiness in the region. LIC will provide a combination of technical assistance and funding for investments. The lessons learned by government and the business community in this programme will be documented and shared with other regions across the country. This will be achieved by working with strategic national partners – public as well as private. LIC will focus geographically on Kigoma and Dodoma regions, and ensure promotion of human rights by including vulnerable groups in the PPD processes and will dedicate particular resources to greening projects. LIC is expected to stimulate economic activities and leverage additional public and private investments in the selected regions. This will be done by supporting the district level stakeholders in the identification of alternative sources of funding and prepare the necessary documentation, e.g. business cases, feasibility studies, environmental impact assessments, etc. Four outcomes are expected from LIC: Outcome 1: Agreement and collaboration among public and private actors on addressing the priorities for local business growth and economic development. Outcome 2: Improved local and sector-specific business environments. Outcome 3: Increased investment in selected regions and value chains. Outcome 4: Improved practices across all regions and districts. It was decided to contract a Management Contractor (MC) to ensure that LIC is managed in the most efficient and effective manner with maximal impact on the local business investment climate. The management contractor will provide TA for each region, for national level support and for the management of the SIFF. The company will act as the manning agent for the SIFF and facilitate LGA and business interaction in all districts of the Dodoma and Kigoma regions. The Ministry of Foreign Affairs has concluded an addendum to the above mentioned existing contract with NIRAS A/S. There have previously been made 2 addendums to the contract. The first addendum was made in 2014 and involved the purchase of two additional vehicles by the consultant as well as an increase of the budget for project related expenses. The contract value was hereby increased with 1,076,000 DKK. The second addendum was made in 2016 and was based on the recommendations from the Final Technical Review Report and the RDE for addition of two new senior TA staff (Finance Manager and Policy Expert) and depletion of funds per diem and hotel and office running expenses. The contract value was hereby increased with 1 780 435 DKK. The third and current addendum includes the following changes to the existing contract: 1) An extension of the employment of Finance Manager and Policy Expert. 2) Employment of a Land Management Expert as a long-term Key Personnel instead of a short-term Personnel. 3) Convertion of the position Project Officer/ME to a Communication and ME team. 4) Procurement of a vehicle to be stationed in Kigoma as the Team Leader will relocate from Dodoma to Kigoma. 5) The provision for monitoring programme interventions (per diem and hotel budget line) will be increased. The Finance Manager and the Policy Expert who both joined in 2016 are continuously needed and consequently included in addendum 3. Additionally, it has been realised that the issue and scope of land management is more complicated than originally foreseen. Therefore, a Land Management Expert needs to be employed as long-term Key Personnel (instead of what was initially foreseen as short-term input). The continued employment of a Finance Manager and Policy Expert and the changed amount of input required from a Land Management Expert is necessary for the performance of the contract in order to achieve the purpose initially intended. During implementation of the programme, it has furthermore been realised that investments are much more complicated to manage than originally foreseen. During the original tender process, it was not possible to predict what the local authorities (LGAs) wished to invest in and consequently, it was not possible to foresee the exact need for monitoring, support and supervision. In order to cope with this, addendum 3 will convert the position of Project Officer/M&E into Communications and M&E team. Consequently, the budget for the Project Officer/M&E is reallocated into the pool of short-term local experts in accordance with the contractual provisions for reallocation of funds. Lastly, an additional vehicle will be procured by the consultant and stationed in Kigoma as the Team Leader will relocate from Dodoma to Kigoma, thereby strengthening supervision of project implementation in Kigoma. Operation costs for vehicles will be increased correspondingly. Finally, provision for monitoring of programme interventions (per diem and hotel budget line) will be increased to reflect corresponding need for close follow-up and supervision of programme interventions. The need for the required adjustments have become clear during phase 1 of the project and is primarily due to external circumstances, which the Embassy could not reasonably forsee and which jeopardize the purpose of the contract if the adjustments are not made. The Project is currently in phase 2, which will end in February 2020. The value of the changes does not exceed 50 % of the original contract price. See also section VII 2.2). Re. VIII.2.3) The contract value before and after the modifications is the contract value including VAT. Without the adjustments covered by addendum 3 the initial purpose of the contract cannot be realised, cf. VI.2.1 The use of another supplier to perform the tasks would lead to a substantial delay and jeopardize the whole programme, as it would not be possible to enter into a contract for the additional services before after a separate tender procedure, bringing the programme close to its end. Including an additional consultant to undertake the tasks covered by addendum 3 would also lead to double contract administration and additional costs as well as further delay, incl. time and cost for ensuring that the new consultant is brought up to speed on the findings and experiences accumulated during the first 4 years and to ensure close coordination with the existing consultant in order to perform the tasks. Including a new consultant would thus result in significant technical and administrative problems as well as significantly increase costs and jeopardize the purpose of the contract. 22400671.00 24250658.00
