Short description

In 2022 the Kenyan Government approved the Sustainable Waste Management Act (SWMA) of 2022 that instills a new paradigm for waste and resource management in Kenya. It introduces new responsibilities in the devolved functions in county governments as well as calls for the introduction of an Extended Producer Responsibility Regulation within two years of the stepping into force of the SWMA of 2022. Following these legal developments the National Environmental Management Agency (NEMA) must update and review the Environmental Management and Coordination Act (EMCA) of 2006 to ensure that provisions for data and reporting requirements necessary for implementing and administering the new act and regulation are in place.

The task is to conduct and produce a gap analysis covering the gap between existing waste data provisions (across governance levels) and the needs following the introduction of the SWMA 2022, the EPR (draft) Regulation 2023, the Model County Waste Management Bill 2023 and other relevant legislation and regulations. The analysis must distinguish between hazardous and non-hazardous waste and include both in the gap analysis report. As a part of the final report the consultant must also produce a list of suggested provisions to close the gap so to speak and bring the Kenyan Waste Data Management into a new sustainable and digital paradigm.

The work must be inclusive of various government levels involved in waste management. Both the central administration revolving around NEMA and the Ministry of Environment, Climate and Forestry (MoECF) as well as the decentralised administrations in the county governments are part of the implementation and management of waste. It is important also to include the non-state players in the waste sector that are waste generators and waste service providers audited through NEMA as well as facilities and infrastructure for waste including material recovery facilities (MRFs).

The work is expected to include desk research, structuring insights, developing diagrams, presenting and engagement with a project group to discuss and enrich the results of the gap analysis. Apart from that various engagements or interviews with other stakeholders from the waste management and waste service sector are expected.
